Also, sometimes we may specifically ask for information about your interests if/when you sign up to use special services, such as chat room and bulletin boards. If you order a product or wish us to store your billing and credit card information or gift reminder information, we will also need to gather such information from you.

You may also print a copy of the information displayed on the Services for your personal use. That means, that except as set forth above, You may not modify, reformat, copy, display, distribute, transmit, publish, license, create derivative works from, transfer or sell any information, products, or service obtained by your use of the Services. This restriction means, among other things, that you may not mirror on your own Website any portion of the Services or display through your own Website any results pages or other information from the Services without LowDial.com's express permission. The technology underlying, and content within, the Services is owned by LowDial.com and/or its licensors (including LowDial.com's advertisers and other content providers). and is protected by copyright and other intellectual property or proprietary rights. If you use the Services LowDial.com site, other than as provided above, you may violate copyright and other laws of the United Kingdom, other countries, as well as applicable state laws and may be subject to penalties. That would not be a good thing. As between you and LowDial.com, LowDial.com owns and retains all ownership of the technology underlying and content within the Services, and reserves all rights not explicitly granted to you in this Agreement.

If you have subscribed to LowDial's Residential services, the Service is provided to you as a single usage residential plan for single family, normal residential use. Single usage means that you and others may not use LowDial for simultaneous calling or as a shared account. LowDial residential use is for your own personal, residential, non-business and non-professional use. This means that you agree not to use, and may not use, the Service for any commercial activities, governmental activities, profit-making activities, and/or non-profit activities, including but not limited to home office, business, sales, tele-commuting, tele-marketing, auto-dialing, continuous or extensive call forwarding, call relaying, fax broadcast, fax blasting and any other activity that would be inconsistent with normal residential usage patterns by any and all residential plans including unlimited plans. This also means that you agree not to, and may not, sell, resell or transfer the Service to any other person for any purpose, or make any charge for the use of the Service, without the prior express written permission from LowDial. You agree that if LowDial determines in its sole discretion that you have used the Service, and/or anyone else has used the Service for any activities and purposes prohibited by this section it may immediately charge you a US$50 per day administrative fee for all periods, including past periods, in which you use or used the service for such prohibited activities. Unusual calling patterns, excessive caller and calling destinations or excessive usage (calculated as a multiple determined by LowDial times the monthly average residential usage of LowDial customers) will be considered as indicators that your use of the Service may be inconsistent with normal residential usage and subject to the terms of this agreement. LowDial makes such determination based on your usage patterns and other criteria determined by LowDial to differentiate between residential and non-residential use. In addition to and without prejudicing or waiving any other remedies that it is entitled to and after it has determined in its sole discretion that you have violated the residential agreement, LowDial reserves the right to (1) terminate the Service and/or (2) charge you excessive usage surcharge of US$35 per month for all months, in which you use or used the Service in inconsistent with normal residential usage manner or in any other manner prohibited by this Agreement. You agree that LowDial may immediately and without prior notice charge such surcharge on your credit card. You agree that any payment made to LowDial pursuant to this section is made as liquidated damages and not as a penalty, because it would be difficult if not impossible to ascertain damages. In the event that LowDial has to take legal action to enforce the provisions of this section, the prevailing party shall be entitled to its reasonable expenses, including attorney’s fees, regardless of whether in house or outside counsel is employed.

3. Return or Refund Policy

All sales are final. No returns or refunds on any purchase. Refunds are allowed only if purchased LowDial product does not work. Refunds cannot be provided for lost, stolen, misused or expired PINs or If purchased product has been used. If you have a problem with the connection or rates/charges, call the customer service number listed on www.LowDial.Com. If you have lost your Pin/Calling Card number or any information of your purchased product then you can retrieve these details by logging into your account at www.LowDial.Com, if you still have any confusion then please call customer support, they are able to retrive it for you after some verifications. Setup fees are non-refundable. In case refund is issued then refund tax will paid by the user or tax amount will be deducted from user balance. All usage from purchase date to refund date will also be deducted from user balance. Remaining balance will be refunded after all these deductions.

4. Disclaimer of Warranties

The services are provided "AS IS" without warranties of any kind, LowDial.Com disclaims any warranties, express or implied including any warranties of Title, Non-infringement, Merchantability or Fitness for a particular purpose.

5. Member Options and Opt-Out Rights

We offer members choices regarding our use of your personal information. You can change or add certain personal information you supplied to us by going to our member services area on your Member Homepage. You can opt-out of receiving email messages from us about products and services that may be of interest to you at any time by going to your Member Homepage. You can also opt-out of having us disclose your personal information to third parties that provide certain features of the service (in which case you will not be able to access or use these features). BE AWARE THAT CHANGES OR ADDITIONS TO YOUR INFORMATION MAY NOT BE PROCESSED IMMEDIATELY, BUT WILL BE PROCESSED AS SOON AS REASONABLY PRACTICABLE. In addition, you should understand that personal information disclosed to third parties prior to your opt-out election being processed will be used according to such third parties' privacy policies. Also, even if you change or add personal information, the previously stored information may still be stored by us or on our behalf (including for archival purposes).

10. Additional Terms and Conditions

- LowDial.Com offers Local numbers to client’s area. Incase Local number is not available exactly in the same city a temporary number can be issued until number is available. LowDial.Com will contact buyer in case Local number from your required city is not available.

- Free Gifts/Free Minutes/Promotions will be delivered only after final approval of service/purchase and payment is made.

- Customer/Client will take full responsibility of the charges (if there is any) by telecom (telephone service provider) to make calls to our Local Numbers/DIDs (Direct Inward Dialing).

- All rates are in US Dollars.

11. Unlimited Pakistan Package Usage Policy.

Following clause is effective from 01-October-2012 only for Unlmited Pakistan Package as Pakistan per minute call rate has been increased by PTA (Pakistan Telecommunication Authority).
Unlimited Pakistan package is limited to 5 (five) unlimited and free calls per day. No matters if call is 2 minutes or 100 minutes longer, call will remain free of cost. 5 (Five) free calls can be dialed anytime in the same day, remaining free calls will not be shifted to next day. Normal call rates will be charged if per day call limit is exceeded. Account balance is needed to make further calls. Invalid or Wrong calls will not be counted.
Number of calls are limited to 5 calls per day but duration of calls are unlimited.

12. Unlimited India Package Usage Policy.

Following clause is effective from 01-August-2013 only for Unlmited India Package.

Unlimited India Plan is a true unlimited plan as far as it is used according to the policy. Frequent usage that goes against to unlimited india policy will be considered as violation and change it from True Unlimited to a Limited plan in current month.
Over 95% of LowDial's residential unlimited calling plan customers use less than 3000 minutes per month and do not have any unusual usage patterns in terms of unique numbers called, high call forwarding/transferring usage and so on. A customer's aggregate usage may be considered outside of normal use if it exceeds 3000 minutes per month IN COMBINATION with one or more of the following, including, but not limited to, excessive:

- unique numbers called;
- call lengths;
- call forwarding/transferring;
- conference calling;
- short duration calls;
- number of calls made during a month,
- number of calls made to a conference calling service during a month;
- number of calls made during business hours;
- number of calls made at a specific number;
- number of calls terminated and re-initiated consecutively, which, in the aggregate, result in excessive call lengths during a specific time frame; or
- other abnormal calling patterns indicative of an attempt to evade enforcement of this Reasonable Use Policy
Based on such a combination, LowDial may determine that abnormal, unreasonable or impermissible usage is occurring when compared to typical customers on the same calling plan, and may take appropriate steps described below to enforce this Policy and the Terms of Service ("LowDial's Rights").

13. Additional Privacy Protections for Children

LowDial.com strongly believes in the potential of the Internet for children's learning and the value of participating in online communities. We are also sensitive to families' concerns regarding children's personal information and safety. Thus, we require parental consent before allowing children under the age of 18 to become members of the web site and to post any data in "public area" of the Website. However, there are some actions that we cannot control and which require assistance from the child's parent or guardian. For example, we can't stop a minor from giving their age in certain areas of our site - but you can and should instruct them against making such disclosures.
